Terms of Service

Acceptance of Terms

By accessing or using the Quaker Partner Portal ("Portal"), you agree to be bound by these Terms of Service ("Term"). If you do not agree, you may not use the Portal. These Terms apply to all partners, dealers, Quaker personnels.

Eligibility and Accounts

Eligibility

You must be an authorized representative of a Quaker partner or dealer, or a Quaker employee, to register. You must be at least 18 years old.

Account Security

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

Permitted Use

The Portal is provided for the legitimate business use of authorized partners and dealers. You agree to use it only in accordance with these Terms and all applicable laws.

Prohibited Activities

  • Sharing your account credentials with another person
  • Reverse engineering, scraping, or attempting to access the Portal in ways not expressly authorized
  • Uploading malware, conducting denial-of-service attacks, or otherwise interfering with the Portal
  • Using the Portal to send unsolicited communications or to violate the rights of any third party
  • Misrepresenting your identity, affiliation, or authorization to access the Portal

Content and Intellectual Property

All product information, technical drawings, marketing materials, software, and other content available through the Portal are owned by Quaker Windows & Doors or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may download and use these materials solely for your authorized business purposes with Quaker.

Submissions

If you submit information through embedded forms or other Portal features, you grant Quaker a non-exclusive, royalty-free license to use that information to provide and improve the Portal and related services.

Third-Party Services

The Portal may embed or link to third-party services such as form providers and training platforms. Your use of those services is governed by their own terms and privacy policies. Quaker is not responsible for third-party content or practices.

Disclaimer of Warranties

The Portal is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Quaker disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Portal will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the fullest extent permitted by law, Quaker and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Portal, even if advised of the possibility of such damages. Quaker's aggregate liability for any claim relating to the Portal will not exceed one hundred U.S. dollars (US$100).

Termination

We may suspend or terminate your access to the Portal at any time, with or without notice, including for any violation of these Terms or for any conduct that we believe is harmful to Quaker, other users, or third parties. Sections of these Terms that by their nature should survive termination will do so.

Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Missouri.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date below indicates the most recent revision. Continued use of the Portal after changes take effect constitutes acceptance of the updated Terms.
